Assisted opening knives could be reclassified as illegal switchblades if a measure proposed by United States Customs and Border Protection (Customs) becomes law.

On May 21, Customs proposed a revision of what constitutes a switchblade (click here to read the proposal). This new interpretation would deem assisted opening knives, as well as those featuring one-hand operation, illegal per the U.S. Switchblade Act of 1958.

Specifically, Customs seeks "revocation of four ruling letters and revocation of treatment relating to the admissibility of certain knives with spring-assisted opening mechanisms." Those four ruling letters do not classify assisted openers as switchblades.

The current federal definition of a switchblade is any knife that opens automatically using gravity, inertia or hand pressure to a button or device on the handle. Assisted openers and one-hand operation knives rely on studs, grooves or other devices attached to the blade to open. These blades must be manipulated by hand to open.

If enacted, the Customs proposal would effect the 35.6 million people who own one-hand operation knives, according to the American Knife & Tool Institute (AKTI). Furthermore, Knife Rights indicates roughly 80 percent of all knives sold in the United States use one-hand operation. The knife industry as a whole employs twenty-four thousand people and contributes an estimated $8 billion annually to the economy, according to Knife Rights.

Both knife advocacy groups are voicing opposition to the measure.

"The [Federal Switchblade] Act is very clear that a switchblade must have an activating button on the handle," a post on Knife Rights's Web site states. "Without a button, it is not a switchblade and this has been upheld by numerous cases on many levels over the years. CBP's convoluted reasoning in their proposal to reach back beyond the law and to expand their regulatory purview by rationalizing 'intent' as justification for this new interpretation is a stretch, at best, and illegitimate at worst."

AKTI filed for an extension of the 30-day minimum public comment period required of Customs. That period ends June 21. AKTI is also drafting an official response to the proposal.

History

This is not the first time Customs sought to restrict assisted opening knives. In 2000, Customs seized 80,000 Columbia River Knife and Tool (CRKT) knives. Over a 16-day period, CRKT lost roughly $1 million in sales due to the seizure, according to AKTI. Customs eventually released the knives back to CRKT.

Seems like you could fight the assisted opening issue just for the fact that people with arthritis or with only one hand would be discriminated against!

big brother watching our backs yet again. Its funny, most folders I own (which is about 30) are assisted opening!

LOL.....guys, I just realized that I will be in prison for life if this law is passed!

I guess everyone will actually have to train with their knives a little bit harder on deployments. Grin  I am ready to go back to the good ol' fashion buck knife or become an outlaw if necessary? Wink I have already sent my letter off to CBP, have you all?  Good thing I have a CCW and I am well trained in unarmed/armed combatives... I am just lucky I guess...

This Will suck for my old SOG Ive had for 20 years.Guess ill just have to stick with a karambit what a joke.How stupid can they get??  dint answer that .I guarantee my karambit models with only a 3" blade will deploy faster and do more damage than any switchblade,assisted,Gravity,etc.
Speaking of Gravity Ive wondered ho long it will take before some moron decides that the use of gravity is required to remove a karambit from a kydex sheath or extend it.
This is ok my woman and I were just discussing lastnight if it would be better to shoot an attacker or stick em.We decided in court your more likely to get away with shooting an attacker than if you deploy a knife for self defence.

You deserve to give yourself a big pat on the back for this. It was your letters, faxes and emails that led to this success. This amendment, if it gets through the Conference Committee, will stop Customs' rulemaking and protect your pocket knives with a permanent solution.


NEWS FLASH: Just in. Our representative who went down and hand counted the letters reports that the final count of Comments letters mailed to Customs is 5,200!!! That is incredible; more than two and half times the original Customs estimate. It is a testament to your outrage over Customs' heavy-handed actions and your dedication. That flood of letters put Customs on notice that they were not going to get away with this without a fight. Thanks to everyone who made that effort to mail their letters to Customs!

Our thanks to Senators Cornyn, Pryor, Hatch, Vitter, Risch, Chambliss, Corker, Enzi, Barrasso, Graham, Roberts, Wyden and Crapo for co-sponsoring this amendment.

We only have one more hurdle, getting through the Conference Committee. Our legislative consultants are already working on that in cooperation with the other advocacy groups and the House members who have been supporting this effort from early on. For the moment, there's not much for you to do and it could be until after the August recess before the Conference Committee meets.

It is never a done deal in politics, until it is actually done. Having said that, we have shown ourselves to be a force to be reckoned with. Right now its time to celebrate our success so far, having overcome great odds to get to this point. We'll be in touch again once we settle on the most effective strategy for the next step.

Who gives a rats ass about the Govt. trying to rip anything (blades, guns etc.) that means absolutely nada to me..no matter what I will carry, legally or illegally..and IMHO it is only illegal if ya get popped....in this mucked up world one would be foolish to go un-heeled in any context. Folks the ZOMBIES are out there and day by day they grow in numbers....so do what you feel is right for you and yours and the rest be damned...I personally am not waiting for the Polizei or Uncle Sam's green weenie to save me or mine....as the sign in my window says.....POLICE WILL ONLY BE SUMMONED AFTER I AM THROUGH.....gotta love that gun show humor.....lol!
